Eh, I think some creative liberties with Captain America can be made since he is really just a super soldier. Yes, in the past he has been portrayed as a superhero but he's been portrayed in many different ways through the years. This iteration looks a lot like Steve Rodgers, Super Soldier which isn't exactly "Captain America" but has a similar look going for it.

Plus, if we're to look at Captain America as a "super American" as he was meant to portray, the "riot cop" look really kind of epitomizes the climate of America at the current time.
